GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern the contractual relations between, on the one hand, the company AMSTEIN S.A. whose registered office is located at Avenue de Gilamont 56 in 1800 Vevey - CHE-101.239.805, hereinafter referred to as "the Seller,"
And any natural or legal person making a purchase of products on amstein.ch, hereinafter referred to as "the Client." The masculine form of the term "Client" applies indiscriminately to people of all genders.

These General Terms and Conditions (GTC) apply without restriction or reservation to all sales concluded by the Seller with the Client, regardless of any clauses that may appear on the Client's documents, including their general purchasing conditions.

Article 1 — Scope
1.1 By validating their order, the Client acknowledges having read, understood, and unreservedly accepted these General Terms and Conditions. These prevail over all other conditions, unless otherwise agreed in writing. The Client guarantees to be legally capable of contracting and certifies the accuracy of the information provided.

1.2 Registration on the site is reserved for individuals capable of performing legal acts. The Client agrees to provide complete, accurate, and up-to-date information during registration, and to update it promptly in case of any changes.

1.3 The sale of alcoholic beverages is prohibited to persons under 16 years of age for beer and wine, and under 18 years of age for spirits. By registering, the Customer confirms that they are of the legal age required.

Article 2 — Products
2.1 The products offered for sale are described on the website www.amstein.ch. These descriptions are provided for informational purposes and do not constitute contractual commitments. The visuals are non-contractual. The Seller disclaims any liability in case of error or omission.

2.2 The products are quality-controlled. The applicable warranty is that of the manufacturer, unless otherwise stated.

2.3 The presentation of the products constitutes an invitation to order and not a contractual offer. The Seller reserves the right to modify the vintages according to availability. In case of a shortage, a later vintage may be delivered, unless otherwise indicated by the Client.

2.4 In accordance with current legislation, the sale of beers, wines, and ciders is prohibited to persons under 16 years of age, and the sale of spirits to persons under 18 years of age. By placing an order, the Customer confirms that they are at least 18 years old. An age verification is conducted once the order is paid for by our partner IDENFY. The Customer account becomes active and the order is processed once this process is completed.

Article 3 — Price
3.1 The displayed prices are expressed in Swiss francs (CHF), including VAT. The delivery costs are indicated separately before the order is confirmed.

3.2 The Seller may change their prices at any time. The applicable price is the one in effect on the date of the order, as indicated in the confirmation sent to the Client.

3.3 Promotional discounts (promotional products) are automatically deducted from the order amount. Promotional codes are valid under the conditions specified at the time of their issuance.

3.4 The offers are valid subject to stock availability.

Article 4 — Order
4.1 The order is final upon payment and confirmation of the Client's age. The order is final as soon as it is paid and the Client's age is confirmed. An invoice is automatically sent by email with an order number once the order amount is paid.

4.2 The Seller reserves the right to cancel any order in case of a price error due to a bug or technical error. The Seller also reserves the right to cancel an order if the amount was not in accordance with the prices normally set for the products and/or delivery fees.

4.3 In case of non-compliance with the age verification process or incorrect data, the Seller may refuse an order.

Article 5 — Payment
5.1 The Client can pay by debit/credit card or TWINT. These payment methods are only available for orders from Switzerland.

5.2 The Seller reserves the right to require prepayment for any new Client or Client with an outstanding balance.

Article 6 — Payment Security and Data Protection
6.1 Payments are secured by encryption (HTTPS) through the company WORLDLINE, TWINT, POSTFINANCE in accordance with PCI standards. The Seller does not have access to banking data.

6.2 The processing of personal data complies with the Federal Act on Data Protection (FADP). The data is used exclusively for the execution of orders and is not transmitted to third parties without consent.

6.3 The data is stored securely and in compliance with legal retention obligations.

6.4 This site uses Google Analytics. The Client can disable cookies in their browser settings.

Article 7 - Delivery
7.1 Delivery is only made in Switzerland and Liechtenstein. Delivery is made to the address indicated by the Customer at the time of ordering.

7.2 Products are delivered by Swiss Post or other carriers. The indicative delivery time is 3 to 6 working days. In the event of unavailability, the Customer will be informed.

7.3 No deliveries are made on Sundays or public holidays.

7.4 Delivery times are indicative. Delays do not entitle the Customer to cancellation or compensation.

7.5 The risks are transferred to the Customer when the goods are deposited. The Customer is responsible for any theft or damage. In case of doubt, it is recommended that the goods be sent with a signature.

Article 8 - Packaging
8.1 The Customer is responsible for the disposal of bottles, cans and packaging.

Article 9 - Delivery costs
9.1 Delivery charges are payable by the Customer and are indicated when the order is placed, depending on the weight and delivery method.

9.2 Rates are fixed according to the delivery method and are detailed in the ‘Delivery conditions’ section of the site.

9.3 Items that are unavailable at the time of dispatch will not be replaced or re-delivered. Refunds will be made in the event of incorrect invoicing.

Article 10 - Retention of title
10.1 The products delivered remain the property of the Vendor until full payment has been received.

Article 11 - Returns and complaints
11.1 The Customer must check the goods on receipt. In the event of damage, he/she must send a photo proof and an explanation within 48 hours to the Vendor by e-mail.

11.2 In the event of an error in the Customer's order, the products will not be returned or reimbursed.

11.3 No replacement will be made for corked bottles.

11.4 If the Customer requests a refund of a specific order or amount on their payment method, the processing of the request may take up to 10 working days depending on the payment services used by the Customer.

Article 12 - Applicable law and place of jurisdiction
12.1 The GTC and the contracts are subject to Swiss law.

Article 13 - Modifications
13.1 The Seller reserves the right to amend the GTC at any time.

13.2 It is the Customer's responsibility to consult the updated GTC regularly.

Only the French version of the GTC shall be binding. The German, English and Italian versions are translations which may contain errors.
